1. Introduction
These Terms and Conditions (“Terms”) govern the provision of medico-legal services by Mr. Marcus Henry Ornstein (“Expert Witness”, “we”, “us”, or “our”). By instructing Mr. Ornstein, you agree to these Terms.

2. Services Provided
Mr. Ornstein provides medico-legal reports and expert witness services in matters relating to personal injury, clinical negligence, and related fields of surgery. Services may include:

  • Review of medical records.
  • Client examination.
  • Report writing.
  • Case-related conferences and meetings.
  • Court attendance as an expert witness.

3. Fees and Payment Terms

  • All fees are exclusive of VAT.
  • The standard hourly rate is £420 per hour (charged per ¼ hour) for report writing, record study, consultations, and meetings.
  • Travel and subsistence are charged at £120 per hour.
  • Fixed cost ‘short’ or screening letter reports (without examination) are charged at £750–£800 after an initial case assessment.
  • Court attendance is charged at £2,500 per day, plus travel and subsistence.
  • Late court cancellation charges:
    • Less than 3 working days’ notice: full charge.
    • Less than 2 weeks’ notice: 50% charge.
    • More than 2 weeks’ notice: no charge.

4. Payment Terms
Payment is expected within 12 months from the date of invoice. Thereafter, 8% annual interest will be added to outstanding balances. We reserve the right to withhold services if invoices remain unpaid beyond the due date.

5. Appointments
Appointments can be arranged in Central London, Guildford, or at the claimant’s home, where necessary. Urgent appointments are possible depending on availability.

6. Report Timelines
Usual turnaround time for reports is 3–4 months, but expedited service may be available upon request, subject to scheduling and case complexity.

7. Case Acceptance
Each case will be assessed upon initial contact (via email or phone) before formal instruction is accepted. We reserve the right to decline a case if it falls outside our scope or availability.

8. Confidentiality
All personal and medical information shared for the purposes of a medico-legal report is treated as confidential and processed in line with applicable data protection laws.

9. Cancellation & Rescheduling
Appointments may be rescheduled with sufficient notice. Any travel or time incurred before cancellation may be chargeable.

10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
